This Privacy Policy is published and shall be construed in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Rules, 2021”) under Information Technology Act, 2000 that require publishing the Rules and Regulations, Privacy Policy and Terms of Use for access or usage of the website located at the URL www.Celebryt.com and/or mobile application under the name and style ‘Celebryt’ (“Celebryt”).
This Privacy Policy covers the information, that M/s. Grammyo Connect Private Limited. (“Celebryt”) collects from the (User(s) or “You” or “Your” or “Yourself”) of Celebryt and the usage of such information. This Privacy Policy is incorporated into and subject to the Celebryt’s Terms and Conditions.
B) When You sign up and register with Celebryt, in addition to the above non-personal information, Celebryt collects Your personal information such as Your User Name, Password, Name, Gender, Age, Date of Birth, Shipping Address, Billing Address, Telephone Number, Mobile Number, E-mail, photos and other files on Your device, contacts saved on Your device, data collected from other applications installed on Your device, Your financial information such as bank account information or credit card or debit card or other payment instrument details, Internet Protocol (IP) Address, Your preferences and usage behaviour on Celebryt, any feedback or review or messages or comments, irrespective of them being, text or voice note or photos or videos, that You may post on Celebryt and/or any other information in the nature of sensitive personal data.
After signing up with Celebryt, You may choose to connect with other User(s) (“Connections”) by giving a request to them or accepting their request. You may also choose to display or hide Your specific personal information in Your profile from, Your Connections and other User(s), as facilitated by Celebryt. The Celebryt shall not be responsible for any unauthorised and/or illegal usage of Your personal information, that You chose to display/share in Your Profile, by Your Connections or other User(s) or for any messages or requests that you may send/receive based on the personal information displayed by You.
The information collected from You is used to,
a) facilitate Your use of Celebryt or other services of Celebryt;
b) provide You with information about product(s) available on Celebryt, to present
advertisements and to send You promotional materials and offers that are tailored to Your preferences and interests.
c) send You online surveys and marketing communications that may interest You.
d) help You address Your problems or grievances incurred in relation to Your transactions with Celebryt.
e) send You notices regarding any changes in Terms of Use, Celebryt policies, guidelines and/or other administrative information.
f) conduct internal reviews, data analysis, analytical studies, research and surveys on user behaviour, user preferences, usage of Celebryt and to measure effectiveness of Celebryt advertisements, offers and promotional materials.
g) for administration of Celebryt.
h) take action against any person who may have violated or is being likely to violate or is causing another to violate any provision of law including the Information Technology Act, 2000 that is likely to have an adverse impact on Celebryt or services provided by Celebryt.
i) Information collected from You will be stored in electronic form and wherever required, in physical form. To store and/or process the information collected from You, Celebryt may enter into contracts with third parties. Celebryt will, on reasonable basis, require such third parties to adopt reasonable security standards to safeguard the information collected from You.
a) Celebryt’s business affiliates or partners to facilitate Your use of Celebryt or to effectively complete and fulfil Your transaction with Celebryt.
b) third parties who may need to contact You for facilitating customer service and customer support.
c) third parties for facilitating marketing and advertising of Celebryt services.
d) another business entity in the event of merger, acquisition, amalgamation, reorganization or restructuring of Celebryt’s business (or assets) with or by such other business entity.
e) respond to legal, judicial, quasi judicial process, law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law.
f) Whenever Celebryt shares Your information with third parties, Celebryt will do so under a confidentiality agreement prohibiting such third parties from sharing Your personal information unlawfully or unauthorized for purposes other than for which Your information is being shared to them.
g) ‘Celebryt’ may provide links to third party sites that may or may not collect personal information from You. Celebryt is not responsible for collection of information by such third party sites or for the privacy policies of such third party sites. Once You are redirected from Celebryt to such third party sites, You are no longer governed by this Privacy Policy or Celebryt Terms of Use. You are highly encouraged to read carefully the privacy policies of such third party sites before using them.
B) Celebryt strives to take reasonable security measures to protect Your personal information which are in its control. However, internet, computer systems, networks and resources are not fully secure. Celebryt, therefore, does not guarantee the security of Your personal information. Celebryt will not be responsible for any breach of security of Your personal information caused either by Your negligence, or breach caused by other Users, Connections or any third parties (including third party sites) receiving Your personal information, or be liable for any loss / misuse in case of events happening beyond the control of Celebryt (including, but not limited to, fire, flood, earthquakes, rainstorms, cyclones, explosions, acts of God, civil commotion, riots, insurrection, war, acts of government, hacking and other kinds of cyber attacks, scraping, use of web crawlers, spiderbots, plug-in, add-ons etc.)
B) By deactivating Your account, You agree that all the information including personal information, posts, photos, videos shared by You, Your messages with other Users and Connections shall be retained by Celebryt and, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our Users, prevent fraud and abuse, enforce our agreements and/or protect our legitimate interests. Where Your Information is no longer required, we will ensure it is securely deleted.
B) User(s) shall also ensure that they do not post or share any information that is, either prohibited by law or unauthorised by the owner(s) and/or author(s) and/or related parties of the information, either through their profile or through Messaging Services. Celebryt shall not be responsible for such unauthorised / illegal usage or sharing of information by the Users. Please refer the Terms and Conditions for all other information.
C) Celebryt is accessible only to users above the age of 18 as detailed in Terms and Conditions. Children under the age of 18 cannot register without the parental consent and in such cases, it is advised that either the Parents or the Guardians of the children shall monitor child’s activities in Celebryt, since Celebryt shall not be responsible for any information shared by the children on their own or to the children by any other Users, Connections or any third parties, through their profile or through Messaging Services.
D) Celebryt shall not be liable for any kind of damages whether personal, monetary, or reputational etc., caused to You, by other Users, Connections or by any third parties or by Your own negligence and Celebryt shall not be proceeded or taken action against, in any such circumstances whatsoever.

b) provide You with information about product(s) available on Celebryt, to present

A) Celebryt may seek permission from its Users to access Location, Contacts, Camera, Gallery, other social media platforms etc., for the purpose of facilitating better usage of Celebryt.V.COOKIES:
A) Cookies are used to collect non-personal information from You or to store Your information for easy access / usage of Celebryt during Your subsequent visits to Celebryt. Cookies, however, do not contain any information that identifies You personally. Cookies stored on Your computer device may be temporary or permanent. You can accept, erase or choose to block these cookies from Your computer by configuring Your internet browser. However, if You have turned cookies off, You shall either not be able to access certain contents of Celebryt or be prevented from using certain features of Celebryt.VI.PAYMENT GATEWAY:
A) All Your payments on Celebryt are currently processed by PhonePe. Your financial information is stored by PhonePe in compliance with industry standards / recommended data security standard for security of financial information. A) Celebryt understands the significance of personal information provided by You on Celebryt. Celebryt, therefore, takes stringent security measures to protect Your personal information and follows reasonable and best industry practices to prevent unauthorized access, use, alteration, or destruction of Your personal information, in accordance with Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.B) Celebryt strives to take reasonable security measures to protect Your personal information which are in its control. VIII. YOUR CONSENT / CHOICE TO OPT-OUT:
A) By using Celebryt and/ or by providing Your information at the time of registration and any time thereafter, You consent to the collection and use of the information You disclose on Celebryt in accordance with this Privacy Policy. If You do not agree to Your Information being collected, used or shared in the manner set out in this Privacy Policy, You could either deactivate Your account or inform Your withdrawal of consent by writing to or contacting Grievance officer under Policy XII (A) of this Privacy Policy, but You may not be able to continue using the services of Celebryt, after withdrawing Your Consent.B) By deactivating Your account, You agree that all the information including personal information, posts, photos, videos shared by You, Your messages with other Users and Connections shall be retained by Celebryt and, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our Users, prevent fraud and abuse, enforce our agreements and/or protect our legitimate interests. Where Your Information is no longer required, we will ensure it is securely deleted.
IX. DISCLAIMER:
A) User(s) shall be solely responsible for information provided/ shared by them, through their account/profile or through messaging, audio/video calling services offered by Celebryt etc., (“Messaging services”) and Celebryt shall not be responsible for unauthorised/illegal storage or usage of such information by Connections or other Users or by any third parties.B) User(s) shall also ensure that they do not post or share any information that is, either prohibited by law or unauthorised by the owner(s) and/or author(s) and/or related parties of the information, either through their profile or through Messaging Services. Celebryt shall not be responsible for such unauthorised / illegal usage or sharing of information by the Users. Please refer the Terms and Conditions for all other information.
C) Celebryt is accessible only to users above the age of 18 as detailed in Terms and Conditions. X.CHANGES TO PRIVACY POLICY:
A) This Privacy Policy is subject to changes from time to time and in the sole discretion of Celebryt. Any changes will be effective upon posting of the revisions on Celebryt. All notice of any such changes or modifications will be posted on Celebryt for thirty (30) days and will be notified to the Users in accordance with the Rules, 2021. Users are responsible for reviewing the notice and any applicable changes. Your continued use of Celebryt following the posting of any changes will constitute your acceptance of such changes or modifications.XI.GOVERNING LAW AND DISPUTE RESOLUTION:
A) This Privacy Policy shall be governed and construed under the laws of India, without any reference to its conflict of law rules and the courts of Bangalore shall have exclusive jurisdiction. In case of any disputes or differences between the Users and Celebryt, the same shall be resolved by Conciliation in accordance with Arbitration and Conciliation Act, 1996. If the said disputes or differences are not settled by Conciliation, the Parties shall resolve them by Arbitration in accordance with Arbitration and Conciliation Act, 1996.XII.GRIEVANCE REDRESSAL:
